By accessing or using Forti365's website and services, you agree to be bound by these Terms and Conditions. Please read them carefully before engaging our services.
"Forti365" refers to Forti365 LLC, its owners, employees, and contractors. "Client" refers to any individual or organization that engages Forti365 for services. "Services" refers to all cloud security consulting, advisory, and review services offered by Forti365. "Deliverables" refers to any reports, checklists, recommendations, or documents produced as part of our services. "Website" refers to forti365.com and all associated subdomains.
Forti365 provides advisory and informational cloud security services. Our recommendations are based on industry best practices and our professional assessment at the time of engagement. We do not guarantee specific security outcomes or that your environment will be free from vulnerabilities. Recommendations may become outdated as cloud services, threats, and compliance requirements evolve over time.
The Client agrees to provide accurate and complete information necessary for us to perform our services. Where applicable, the Client will grant read-only access to their AWS environment for the purpose of conducting security reviews. The Client is responsible for independently evaluating all recommendations and deciding whether to implement them in their environment.
Service pricing is as listed on our pricing page and is quoted in US Dollars (USD). Specific payment terms and methods will be discussed during your initial consultation call. We reserve the right to update pricing at any time, though any agreed-upon price will be honored for the duration of that engagement.
All sales are final once deliverables have been provided. If you wish to cancel an engagement before work has begun, you may do so for a full refund. Once a security review or consultation has commenced, no refunds will be issued for work already completed.
When conducting security reviews, Forti365 requires read-only access to your AWS account. This access is used solely for the purpose of performing the agreed-upon security assessment. Access credentials will be revoked upon completion of the engagement, and we will not retain access beyond what is necessary to deliver the service.
Forti365 will treat all Client information, including AWS configurations, architecture details, and business data, as strictly confidential. We will not disclose your information to third parties without your consent. All deliverables are intended for the Client's internal use only and should not be shared publicly without our written permission.
Our services are provided "AS IS" without warranties of any kind, either express or implied. Forti365 does not guarantee that implementing our recommendations will prevent all security incidents. We do not warrant that our services will identify every vulnerability in your environment, and we disclaim any implied warranties of merchantability or fitness for a particular purpose.
Forti365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. This includes, but is not limited to, loss of data, revenue, or business opportunities. Our total liability for any claim shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
The Client agrees to indemnify and hold harmless Forti365 from any claims, damages, or expenses arising from the Client's use or implementation of our recommendations, any breach of these Terms by the Client, or any third-party claims related to the Client's AWS environment or business operations.
All content on the Forti365 website, including text, graphics, logos, and methodologies, is our intellectual property and is protected by applicable copyright laws. Deliverables produced for a Client are licensed for that Client's internal use only. Clients may not resell, redistribute, or publicly share deliverables without prior written consent.
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation within 30 days of written notice. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in the State of Florida, conducted under the rules of the American Arbitration Association.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings shall take place in the courts of Florida.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary. All remaining provisions shall continue in full force and effect.
Forti365 reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
